1. Acceptance of Terms

By downloading, installing, or using the GentlePrep mobile application ("the App") or visiting the GentlePrep website ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Website.

These Terms constitute a legally binding agreement between you and Dodecki Labs LLC ("we," "us," or "our"). You must be at least 13 years of age to use GentlePrep.

2. Description of Service

GentlePrep is a mobile companion application designed to help users manage their colonoscopy preparation process. The App provides features including timed reminders, hydration tracking, stool clarity tracking, medication management, a recap report, and an AI-powered prep companion.

The App is available as a free download with optional premium features available through in-app purchase. We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice.

3. Medical Disclaimer

GentlePrep is not a medical device and does not provide medical advice, diagnosis, or treatment. The information provided by the App, including content from the AI prep companion, is for general informational purposes only and should not be considered a substitute for professional medical advice.

Always follow the specific preparation instructions provided by your gastroenterologist or healthcare provider. If the information in GentlePrep conflicts with your doctor's instructions, follow your doctor's instructions.

You should never delay seeking medical advice, disregard medical advice, or discontinue medical treatment based on information provided by GentlePrep. If you experience a medical emergency during your colonoscopy preparation, call your local emergency number immediately.

The chat companion feature provides automated answers to common preparation questions. Responses are generated by a third-party language processing service and may occasionally contain errors or inaccuracies. Chat responses do not constitute medical advice and should not replace consultation with your healthcare provider.

4. User Accounts and Data

GentlePrep does not require an account to use the core features. If you purchase premium features, your purchase is managed through Apple's App Store or Google Play and is subject to their respective terms and refund policies.

Your preparation data is stored locally on your device. You are responsible for maintaining the security of your device. We are not responsible for data loss resulting from device damage, loss, theft, or operating system updates.

5. Intellectual Property

The GentlePrep app, website, and all associated content — including but not limited to text, graphics, logos, icons, images, audio, and software — are the property of Dodecki Labs LLC and are protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use GentlePrep for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse-engineer or attempt to extract the source code.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Dodecki Labs LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or in connection with your use of GentlePrep.

GentlePrep is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. Our total liability for any claims arising from or related to these Terms or your use of GentlePrep shall not exceed the amount you paid for the App in the twelve months preceding the claim.

7. Termination

We may terminate or suspend your access to GentlePrep at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

You may terminate your use of GentlePrep at any time by uninstalling the App from your device. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Intellectual Property, and Governing Law) will continue to apply.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of GentlePrep shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action lawsuit.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of GentlePrep after changes are posted constitutes acceptance of the revised Terms.

We encourage you to review these Terms periodically. If a change materially reduces your rights, we will make reasonable efforts to notify you through the App or by other means.
